2. The following information concerns rights and procedures that relate to this proceeding for the termination of custody and control of said minor as set forth in Probate Code Section 1516.5:

A. At the beginning of the proceeding the court will consider whether or not the interest of WYATT require the appointment of counsel. If the court finds that the interests of WYATT do require such protection, the court will appoint counsel to represent him, whether or not he is able to afford counsel. WYATT will not be present in court unless he requests or the court so orders.

B. You are required to be present at the hearing and you have the right to be represented by an attorney. If you appear without counsel and are unable to afford counsel, the court must appoint counsel for you, unless you knowingly and intelligently waive the right to be represented by counsel. The court will not appoint the same counsel to represent both you and WYATT.

C. The court may appoint ether the public defender or private counsel. If private counsel is appointed, he or she will receive a reasonable sum for compensation and expenses, the amount of which will be determined by the court. That amount must be paid by the real parties in interest, but not by the minor, in such proportion as the court believes to be just. If, however, the court finds that any of the real parties in interest cannot afford counsel, the amount will be paid by the county.

D. The court may continue the proceeding for not more than thirty (30) days as necessary to appoint counsel to become acquainted with the case.

E. The court will proceed with this hearing whether or not you are present.

F. If the court terminates your parental rights, the order may be final.
