NOTICE! You have been sued.  The court may decide against you without your being heard unless you respond within 30 days. Read the information below.

You have 30 CALENDAR DAYS after this summons and legal papers are served on you to file a written response at this court and have a copy served on the plaintiff. A letter or phone call will not protect you. Your written response must be in proper legal form if you want the court to hear your case. There may be a court form that you can use for your response. You can find these court forms and more information at the California Courts Online Self-Help Center (www.courtinfo.ca.gov/selfhelp), your county law library, or the courthouse nearest you. If you cannot pay the filing fee, ask the court clerk for a fee waiver form. If you do not file your response on time, you may lose the case by default, and your wages, money and property may be taken without further warning form the court.

There are other legal requirements. You may want to call an attorney right away.  If you do not know an attorney you may want to call an attorney referral service. If you cannot afford an attorney, you may be eligible for free legal services from a nonprofit legal services program. You can locate these nonprofit groups at the California Legal Services Web site (www.lawhelpcalifornia.org), the California Courts Online Self-Help Center (www.courtinfo.ca.gov/selfhelp), or by contacting your local court or county bar association. NOTE: The court has a statutory lien for waived fees and costs on any settlement or arbitration award of $10,000 or more in a civil case. The court’s lien must be paid before the court will dismiss the case.

FREED

PARENTAL
CUSTODY
AND
CONTROL

(Family Code § 7822)

6-16-23 @ 8:30 a.m. Dept.: J-1

TO:  Respondent/father DAVID MICHAEL NORTHCUT:

By order of this court you are hereby advised that you may appear before a judge of the Ventura County Superior Court, in Department J-1 , located at 4353 Vineyard Avenue, Oxnard, California 93036, on the date of  June 16, 2023 at the hour of 8:30 A.M. to show cause, if you have any reason why the above-named minor child should not be declared free from your custody and control, according to the Petition filed herein under Family Code § 7822.

The petition to declare the child free from the custody and control has been filed for the purpose of freeing the minor child for adoption by the Petitioners.

For failure to attend, you may be deemed guilty of contempt of court.

You have the right to be represented by counsel. If you appear without counsel, and are unable to afford counsel, upon your request, the court shall appoint legal counsel to represent you.  The court may appoint counsel to represent the minor, whether or not the minor can afford counsel.  Private counsel appointed by the court shall be paid a reasonable sum for compensation and expenses, in an amount to be determined by the court and which amount may be ordered paid by the parties, other than the child, in proportions the court deems just.  However, if a party is unable to afford counsel, the amount shall be paid out of the county’s general fund.

The court may continue the proceeding for not to exceed 30 days as necessary to appoint counsel and to enable counsel to become acquainted with the case.

The minor will not be present in court unless the minor so requests or the court so orders.

If you fail to attend the hearing, the child may be declared freed from your parental custody and control, and/or the court may deem your consent to the adoption is not necessary, and the child may be adopted by the Petitioners, without further notice to you.
