ANNETTE FEDERICO, (“Petitioner”), adult child of ANTHONY FEDERICO (“ Decedent” ), hereby respectfully submits this Petition to Terminate the life estate of the Trust Property to Rita Federico; for Damages; and for Attorney’s Fees and Costs (“ Petition” ), and alleges as follows:
I.
JURISDICTION,
VENUE,
AND
NOTICE
1. Petitioner is Settlor’s daughter and Successor Trustee of the ANTHONY FEDERICO TRUST, and is informed and believes and based thereon alleges she is a beneficiary and Successor Trustee under the Settlor’s Trust, giving her standing to submit this Petition. Petitioner reserves the right to amend this Petition or file a new petition concerning the validity of any trust instrument Settlor may have executed if the evidence suggests the validity of such document(s) is in question.
2. Petition is informed and believes and based thereon alleges that respondent RITA FEDERICO resides in the city of Reseda, county of Los Angeles, California. Settlor also resided in Los Angeles County, California prior to his death.
3. The proper county for commencement of proceedings pursuant to Probate
Code section 17200 is the county where the principal place of administration of the trust is located. Prob.
Code § 17005(a) (1). Probate
Code section 17200 defines “principal place of administration” as “the usual place where day-to-day activity of the trust is carried on by the trustee or its representatives who are primarily responsible for the administration of the trust.” The Trust is being administered in Los Angeles County, California.
Anthony Federico died 12/03/2011. Attached hereto is the death certificate as Exhibit

4. Pursuant to Probate
Code section 851, Petitioner will personally serve this Petition on Respondent. Pursuant to Probate
Code section 17203, Petitioner will provide notice at least 30 days before the time set for the hearing on the Petition, including notice of the time and place of hearing, to the following persons:

II.
FACTUAL
BACKGROUND
6. On or about July 31, 1994, Settlor created a Trust on his own behalf. Petitioner has a copy of the Trust and attaches it hereto as Exhibit
B.
7. Petitioner is informed and believes and based thereon alleges that Respondent is awarded a life estate by the Trust, a Life Estate in Decedent’s property. Respondent owes Petitioner and other beneficiaries of the Trust fiduciary duties as trustee. The Trust left the real property to 1/3 to Annette Federico, 1/3 to Diane Greenberg, and 1/3 to Debbie Street.

8. Respondent has completed multiple breaches of fiduciary duty warranting her immediate removal and vacating of her life estate for the significant damage she has caused. This is an urgent matter. Respondent is actively draining the Trust’s assets as the home is in disrepair. The Respondent has refused to pay the taxes on the property, (California Civil
Code § 840) and the taxes have been paid by Annette Federico, aka Annette Collins for years 2021, 2022, and 2023. Respondent has declined to maintain proper insurance on the home, an asset of the trust. She is not providing upkeep or normal maintenance of the property, and has allowed the property to go into disrepair devaluing the value of the property. She refuses to allow inspection of the property, and notice by mail was given to Ms. Federico, (see Letter attached as Exhibit
C).
9. Respondent has refused for more than a month after written demand from Petitioner (through counsel) to pay the taxes, allow inspection of the property, maintain the property and respond to the demand. Respondent must protect and maintain all of Settlor’s Trust assets since Respondent assumed control of the Trust assets on decedent’s date of death, 2011.
10. Petitioner requests that she, Annette Federico aka Annette Collins, be recognized as the successor trustee to take title to all Trust assets so they may be preserved and protected.
11. Petitioner also requests Respondent to provide an accounting, repay the taxes, provide property insurance for the residence, prove it is properly maintained, and to surcharge her for her breach of fiduciary duty by her failure to maintain the property, pay the taxes and maintain insurance on the property, and order her to pay double damages and Petitioner’s attorney’s fees and costs.
12. Petitioner is unaware of the true names and capacities of respondents sued herein as DOES 1 50, inclusive.

Code section 850(a) (3)(B) states that a trustee or interested person may file a petition “where the trustee has a claim to real or personal property, title to or possession of which is held by another.: See also Estate
of
Heggstad (1993) 16 Cal.App.4th 943. Thus, “{i}f the court is satisfied that a conveyance, transfer, or other order should be made, the court shall make an order authorizing and directing personal representative or other fiduciary, or the person having title to or possession of the property, to execute a conveyance or transfer to the person entitled thereto, or granting other appropriate relief.” Prob.
Code § 856.
15. The Petitioner is one of the three contingent beneficiaries of the property in question. Settlor owned the property upon his death. Since the settlor s passing in 2011, Respondent has lived in the home and failed to pay the property taxes, maintain the property, and allow inspection. It should presently remain in decedents Trust’s name, in the name of the Trust, in Respondent’s name as successor trustee, or someone else altogether. Since it is requested that Respondent be suspended and removed from her life estate, and the property be transferred to the contingent beneficiaries, it is requested the Court recognize and appoint Petitioner as successor trustee, and confirm the legal title of the subject property in Petitioner’s name as trustee of the Anthony Federico Trust. Petitioner also respectfully requests this Court to order Respondent and any other necessary person (the Trustee to sign documents if needed) to execute any deeds or other documents necessary to effectuate the transfer of title to Petitioner as trustee. See Prob.
Code § 856.
16. Property: Settlor’s primary residence: 18221 Strathern St., Reseda, CA 91335. Settlor owned the as his sole property in his name. Petitioner would like to sell the property and divide the proceeds between the three contingent beneficiaries.

18. Pursuant to Probate
Code
section 16060 ,a trustee is duty bound to keep the beneficiaries of a trust reasonably informed of the trust and its administration. Except in certain instances not applicable here, upon the reasonable request of a beneficiary, the trustee must report to the beneficiary by providing requested relating to the administration of the trust relevant to the beneficiary’s interest. See
Prob.
Code § 16061; Esslinger v. Cummins (2006)144Cal.App.4th 517,526. The Petitioner is designated as the Trustee in the Trust. This includes the right to inspect and determine if trust property is “being wasted” or is in danger of a reduction in value. A beneficiary (even if not currently entitled to receive distributions), or the Court on its own motion, can terminate the life estate of a beneficiary who has violated the Code to maintain the property.
19. By the time of the hearing on this Petition, Petitioner is informed and believes that more than 60 days from the request will have run, and, as a court of equity, it is requested that the Court measure the relief based on the state of the facts at the time of its determination as opposed to the state of the facts at the time of filing. Unlike in matters at law, in matters of equity, the right to judgment depends upon the facts as they exists at the time of the court’s decision. See
Renz
v.
33rd
District
Agricultural
Association (1995) 39 Cal.App.4th 61; Hutcherson
v.
Alexander
(1968) 264 Cal.App.2d; Collins
v.
Sargent (1928) 89 Cal.App. 107, 112.
20. Petitioner expects Respondent will argue she is not required to provide the payment of the taxes, to maintain the property, account for the maintenance of the property, or to allow inspection because she claims she is complying with the Trust’s terms. The trustee (in this case the Petitioner), has the duty to keep beneficiaries reasonably informed, and with that, the duty to provide a report of information can include a full accounting and determination as to the protection of the property to prevent or remedy a breach of trust, or in this case destruction of the value of the property or for other good cause shown. See Prob.
Code §§ 16064(a) & (b); Esslinger, 144 Cal.App.4th at 526; Christie, 202 Cal.App.4th at 1412-13.
22. Petitioner requests the Court to compel Respondent to provide to the Court and Petitioner proof of payment of the taxes, proof that the property is maintained and proof that the property may be inspected by the Petitioner/Trustee from the date of decedent s death through the present. In the alternative, the Court is requested to end the life estate.
23. Respondent Rita Federico has breached numerous fiduciary duties as to the maintenance of the property, pay the taxes and obtain insurance as described above. Petitioner requests that the Court surcharge Respondent in an amount to be determined at trial for all losses incurred by the Trust, plus interest and any expensed paid by the Trustee as a result of Rita Federico’s breaches. It is further requested that the Court award double damages, attorney’s fees, and costs against Respondent based on her bad faith conduct as described in this Petition.

PRAYER
FOR
RELIEF
WHEREFORE, Petitioner prays for an Order of this Court:
1. That all notices have been given according to law;
2. That Rita Federico’s Life Estate in the 18221 Strathern St. property be terminated:
a. Respondent reimburses Petitioner for the property taxes for years for 2021, 2022 and 2023;
b. Respondent maintains property insurance; and
c. Respondent allows future inspections of the property at least one time each quarter.
3. Respondent must vacate the property as the tenant to allow the sale of the property;
4. The proceeds of the sale of the property shall be equally distributed as set forth in the Trust;
5. Respondent shall be surcharged for damages and interest in an amount to be determined at trial;
6. Double damages for expenses paid by Petitioner to maintain the property and against Respondent; and attorney’s fees and costs awarded to Petitioner in an amount to be determined at trial; and
7. For such other orders as the Court considers proper.
