SAN FERNANDO (CNS) – A Pacoima man accused of leaving his 6-month-old daughter outside in cold weather early Christmas morning, then passing out drunk on a couch inside, pleaded not guilty to child endangerment charges.
Jose Chavarria, 29, is charged with two counts of child endangerment and one count of resisting arrest, according to the City Attorney’s Office. If convicted, he could face up to two years in jail and $2,000 in fines.
Neighbors reported finding the baby crying in a stroller outside Chavarria’s home about 2:10 a.m. on Christmas morning. Prosecutors said the temperature outside was 49 degrees, and witnesses told police the infant was uncovered and cold to the touch.
Officers found Chavarria passed out on a couch inside his residence and said he appeared to be heavily intoxicated, according to prosecutors. He was allegedly belligerent and struggled briefly with the officers before being arrested.
The infant was placed in the custody of the Department of Children and Family Services.
Chavarria has been behind bars since Christmas in lieu of $100,000 bail.
He is due back in court Jan. 13, when a preliminary hearing date is scheduled to be set.
